Welcome to The Daily Tally. These Terms of Service ("Terms") govern your use of the website located at thedailytally.app ("the Service"), operated by The Daily Tally LLC, a California limited liability company ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
By accessing or using The Daily Tally, you confirm that you have read, understood, and agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. We may update these Terms from time to time, and your continued use of the Service after any changes constitutes acceptance of the revised Terms.
The Daily Tally is a free daily trivia game available through your web browser. The Service includes a main daily trivia game and category-specific variant games. You can play without creating an account, in which case your progress is stored locally on your device. You may also create an account using your email address to enable additional features such as score tracking across devices. The Service is provided free of charge. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.
Playing Without an Account. You may use the Service without creating an account. In this case, your game progress, scores, and streaks are stored in your browser's local storage. We are not responsible for any loss of locally stored data due to clearing your browser data, switching devices, or any other cause.
Creating an Account. You may create an account by providing a valid email address and authenticating through our system. When you create an account, you agree to provide accurate and complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.
Age Requirement. You must be at least 13 years of age to create an account. If you are under 18, you represent that you have the consent of a parent or legal guardian to use the Service.

"The Daily Tally" name, logo, and associated branding are trademarks of The Daily Tally LLC.
The Service may allow you to submit trivia question suggestions ("User Submissions"). By submitting content, you grant The Daily Tally LLC a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, modify, adapt, publish, and distribute your submissions. You represent that your submissions are original and do not infringe on any third party's rights. We are under no obligation to use or compensate you for any submissions.
The Service is provided on an "as is" and "as available" basis, without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We do not warrant the accuracy or reliability of any content, including trivia questions and answers. Your use of the Service is at your own risk.
To the fullest extent permitted by law, The Daily Tally LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed fifty dollars ($50.00 USD).
We may suspend or terminate your access to the Service at any time, with or without cause. You may stop using the Service at any time. If you have an account, you may request deletion by contacting us.
We may update these Terms from time to time. We will notify you by posting the updated Terms on this page with a revised effective date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of California. Any disputes shall be resolved exclusively in the state or federal courts located in California.

This Privacy Policy describes how The Daily Tally LLC ("we," "us," or "our") collects, uses, and shares information when you use The Daily Tally at thedailytally.app (the "Service"). We are a California limited liability company committed to protecting your privacy.
Information You Provide. Creating an account is optional. If you choose to create one, we collect your email address. If you submit trivia questions, we may collect the content of your submission.
Information Collected Automatically. We collect game scores, answer selections, streaks, and completion times. For anonymous users, this data is stored locally on your device. For registered users, this data is stored on our servers. Our hosting provider may collect standard server log data such as IP address and browser type.
Information We Do Not Collect. We do not collect financial information, precise geolocation data, or data from third-party social media accounts.
We use your information to operate and maintain the Service, display community statistics, communicate with account holders, review trivia submissions, and detect and prevent abuse. We do not use your information for advertising. We do not sell your personal information.
Anonymous Users. Your game data is stored exclusively in your browser's localStorage on your device. We do not have access to this data.
Registered Users. Your account information and game data are stored on servers provided by Supabase (AWS infrastructure) with industry-standard security measures including encryption in transit and at rest.
We do not sell, rent, or trade your personal information. We may share information with service providers (Supabase, Cloudflare) to operate the Service, share aggregated community statistics, disclose information if required by law, or transfer information in connection with a business transaction.
If you are a California resident, you have the right to know what personal information we collect, request deletion of your data, and not be discriminated against for exercising your rights. We do not sell personal information.
Categories of Personal Information Collected: Identifiers (email, IP address) and internet activity (game scores, answers, streaks, completion times).
To exercise your rights, contact us at privacy@thedailytally.app. We will respond within 45 days as required by law.
We retain account data for as long as your account is active. Upon deletion request, we will remove your personal information within 30 days. Browser localStorage data persists until you clear your browser data. Trivia submissions may be retained indefinitely, but associated personal information can be removed upon request.
The Service is not intended for children under 13. We do not knowingly collect personal information from children under 13. If we become aware of such collection, we will delete that information promptly. Contact us at privacy@thedailytally.app if you believe a child under 13 has provided us with personal information.
We do not use cookies for tracking or advertising. Supabase may use authentication tokens to maintain login sessions. We use localStorage to save game progress for anonymous play. You can clear localStorage through your browser settings at any time.
The Service uses Supabase (database and authentication), Cloudflare (hosting and security), and Google Fonts (typefaces). Each provider may process limited technical data. We do not use any third-party analytics, advertising, or social media tracking tools.
We may update this Privacy Policy from time to time. Material changes will be posted on this page with a revised effective date. Your continued use of the Service after changes indicates acceptance of the updated policy.
